Important: Please read these terms carefully before using KiesSlim. By accessing or using our platform, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using KiesSlim ("we," "our," "us"), you ("user," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use our platform.
These Terms constitute a legally binding agreement between you and KiesSlim, governing your use of our website and related services (collectively, the "Service").
2. About KiesSlim
KiesSlim is a South African platform that connects vendors — flea market, festival, church bazaar, school fête, fundraiser, and pop-up event vendors — with the organisers who need them. Organisers list events and describe the kind of vendors they're looking for; vendors set up a profile describing what they sell and how far they'll travel, and are automatically shown events that match. KiesSlim does not organise events, sell goods, or provide any of the services listed on the platform — we facilitate discovery and introduction only.
The entire platform requires an account to use. There is no public directory or listing visible without logging in.

3. Platform Role and Limitations
BY USING KIESSLIM, YOU EXPLICITLY ACKNOWLEDGE AND AGREE TO ALL LIMITATIONS SET OUT IN THIS SECTION. IF YOU DO NOT ACCEPT THESE LIMITATIONS, YOU MAY NOT USE THE PLATFORM.
3.1 Intermediary Platform Only
KiesSlim operates solely as an electronic intermediary platform as contemplated under the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act"). We facilitate the discovery of, and introduction between, vendors and event organisers. We do not organise, run, staff, supply, endorse, insure, or warrant any event or vendor listed on the platform, and we are not a party to any agreement, booking, or transaction concluded between a vendor and an organiser.
3.2 No In-Platform Bookings, Applications, or Payments
KiesSlim shows a vendor which events match their profile, and shows the organiser's contact details (and vice versa where applicable) so the two parties can get in touch directly. There is no application, booking, payment, or acceptance/rejection workflow on the platform. Any contact, negotiation, stall booking, deposit, payment, or agreement happens entirely off-platform, directly between the vendor and the organiser, using whatever contact method they choose (phone, WhatsApp, email, or otherwise).
KiesSlim has no visibility into, control over, or responsibility for what is agreed between a vendor and an organiser after they make contact.
3.3 No Verification of Vendors or Organisers
IMPORTANT — PLEASE READ CAREFULLY:
Anyone can register as a vendor or an organiser by providing self-reported information. KiesSlim does not independently verify the identity, legitimacy, registration status, insurance, food safety compliance, or trading history of any vendor, and does not independently verify that any listed event is genuine, will take place, or will match its published description.
By using the platform — whether as a vendor or an organiser — you acknowledge and accept that:
- • An event listing may be inaccurate, outdated, incomplete, or created by someone without authority to organise the event described.
- • A vendor profile may be inaccurate, incomplete, or created by someone who cannot actually supply what is described.
- • KiesSlim bears no liability for the consequences of any inaccurate, misleading, fraudulent, or unauthorised listing or profile.
Before travelling to an event or committing to book a stall, vendors should independently confirm the event's details directly with the organiser. Before confirming a vendor for an event, organisers should independently satisfy themselves as to the vendor's suitability, legitimacy, and any required licences, permits, or insurance.
3.4 No Involvement in Disputes — South African Legal System Applies
BY USING KIESSLIM YOU EXPRESSLY AGREE THAT:
- • KiesSlim will not under any circumstances act as mediator, arbitrator, adjudicator, or conciliator in any dispute between a vendor and an organiser, or between any other users of the platform.
- • All disputes arising from a stall booking, cancellation, no-show, non-payment, misrepresented event, or any other matter between a vendor and an organiser must be resolved directly between the parties involved, without the involvement of KiesSlim.
- • Where a dispute cannot be resolved directly between the parties, you agree that such dispute shall be resolved exclusively through the South African legal system, including but not limited to the Magistrates' Court, the High Court, or any other competent South African tribunal or regulatory body having jurisdiction over the subject matter of the dispute.
- • You irrevocably waive any right to call upon KiesSlim to intervene in, mediate, or resolve any dispute of any nature whatsoever between yourself and any other platform user.
- • You indemnify and hold KiesSlim harmless from any claim, loss, damage, or liability — whether direct, indirect, consequential, or otherwise — arising from any dispute between you and another user.
3.5 User Responsibility
As a platform user you are solely responsible for:
- • Independently verifying any event or vendor before travelling, committing, or paying any money.
- • Negotiating, agreeing, and concluding the terms of any stall booking or arrangement directly with the other party.
- • Resolving any payment disputes, cancellations, no-shows, or delivery complaints directly with the other party.
- • Pursuing your own independent legal remedies through the South African legal system where disputes cannot be resolved amicably.
- • Ensuring your own compliance with any licences, permits, food safety, insurance, or municipal by-law requirements applicable to your business or event.
3.6 Matching Is Automated and Approximate
KiesSlim shows a vendor which published events fall within their chosen travel distance and match at least one category they sell. This matching is calculated automatically from town-level location data and the categories and distance a vendor has selected, and from the vendor types an organiser has specified. KiesSlim does not guarantee that this matching is complete, accurate, or that it will surface every relevant event or every relevant vendor. Location data for some towns may be missing or approximate, and category selections are self-reported by users. Vendors and organisers should not rely solely on the matching results and should use the platform's search tools to check for opportunities beyond their default settings.
3.7 Statutory Compliance
These limitations are consistent with and governed by South African law, including the ECT Act 25 of 2002, the Consumer Protection Act 68 of 2008 (to the extent applicable), and the Protection of Personal Information Act 4 of 2013 ("POPI Act"). Nothing in these Terms is intended to limit any statutory right you may hold under South African law; where any provision conflicts with such statutory rights, those rights will prevail to the extent of the conflict.
⚖️ By continuing to use KiesSlim you confirm that you have read, understood, and accepted the limitations set out in this section. If you do not agree, you must stop using the platform immediately.
4. User Accounts and Registration
4.1 Account Types
At registration you choose to register as either a Vendor or an Organiser. Each account belongs to one type only. If you operate as both, you must register a separate account for each role, using a different email address for each.
4.2 Account Requirements
- You must be at least 18 years old to create an account
- You must provide accurate, current, and complete information
- You are responsible for maintaining the confidentiality of your account credentials
4.3 Account Responsibilities
- You are solely responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
- Keep your event listings and vendor profile information current — outdated information leads to poor matches and wasted trips for the other party
5. Event Listings and Vendor Profiles
5.1 Organisers — Event Listings
AS AN ORGANISER, YOU AGREE THAT:
- The event details you submit (name, date, venue, town, vendor types wanted, and any pricing or facility information) must be accurate and kept up to date.
- Your listed contact information (contact person, phone, WhatsApp, and/or email) will be shown to any vendor whose profile matches your event, so that they can contact you directly.
- You must publish or unpublish your event promptly if its status changes (e.g. cancelled, fully booked, or details changed materially).
5.2 Vendors — Profiles and Saved Statuses
AS A VENDOR, YOU AGREE THAT:
- Your profile information (business name, categories, town, and travel radius) must be accurate so that events are matched to you correctly.
- Your business name and the categories you sell are used to help match you with relevant events; your own account's contact email is not shown to organisers or other users unless you choose to share it directly with them yourself.
- Marking an event as "Interested," "Going," or removing it from your dashboard is a private organisational tool for your own use only — it is never shown to the organiser or any other user, and does not notify anyone or constitute any form of booking or confirmation.
5.3 No Ownership Transfer, Content Remains Yours
You retain ownership of the event listings and profile content you submit. By submitting content, you grant KiesSlim a non-exclusive, worldwide licence to store, process, and display that content within the platform for the purpose of operating the matching service described in these Terms. Unlike some other platforms, we do not claim ownership of your content, and we do not keep it indefinitely once you delete your account or listing — see our Privacy Policy for retention details.
6. Prohibited Activities
You agree NOT to:
Content Violations
- • Post a fake event that does not exist or will not take place
- • Create a vendor profile for a business you do not operate or represent
- • Post defamatory, offensive, or illegal content
- • Advertise illegal goods or services
Platform Abuse
- • Create fake accounts or impersonate others
- • Register multiple accounts for the same person or business
- • Spam or harass other users
- • Attempt to hack or disrupt our services
Commercial Misuse
- • Use our platform for unauthorized commercial purposes
- • Scrape or harvest data without permission
- • Use contact details obtained through the platform to spam users about unrelated offers
Legal Violations
- • Violate any applicable laws or regulations
- • Infringe on privacy rights of others
- • Share confidential information without consent
- • Engage in discriminatory practices
7. Intellectual Property Rights
7.1 KiesSlim's Rights
KiesSlim owns all rights to our platform, including but not limited to:
- Website design, layout, and functionality
- KiesSlim branding, logos, and trademarks
- The matching logic and underlying software
- Aggregated, anonymised data and analytics
7.2 Content Licence
By submitting an event listing or vendor profile to KiesSlim, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and display that content for the purpose of operating the platform as described in these Terms. This licence ends when you delete the listing, profile, or your account, subject to the retention periods described in our Privacy Policy.
8. Privacy and Data Protection
Your use of KiesSlim is also governed by our Privacy Policy, which complies with South Africa's Protection of Personal Information Act (POPI Act). By using our platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
Key point: an organiser's event contact details are shown to matching vendors, and a vendor's business name and categories are used for matching — see our Privacy Policy for exactly what is shared, with whom, and why.
9. Disclaimers and Limitations of Liability
9.1 Service Disclaimer

- • KiesSlim is ONLY a matching platform — we do not organise events or supply vendors
- • We do NOT guarantee that any event will take place, or that any vendor will attend or perform as expected
- • We do NOT guarantee the completeness or accuracy of automated matching
- • 🚫 WE WILL NOT GET INVOLVED IN ANY DISPUTES between vendors and organisers
- • ALL DISPUTE RESOLUTION IS BETWEEN USERS DIRECTLY
- • Service availability may be interrupted or terminated without notice
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, KIESSLIM SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, wasted travel costs, stall fees, deposits, or business opportunities
- Damages arising from user-submitted content (event listings or vendor profiles) or third-party actions
- Service interruptions, technical failures, or data breaches beyond our control
- Any amount exceeding the fees paid by you to KiesSlim in the preceding 12 months (currently R0, as the platform is free)
10. Indemnification
You agree to indemnify, defend, and hold harmless KiesSlim, its officers, directors, employees, and agents from any claims, damages, costs, or expenses (including reasonable attorney fees) arising from:
- Your use of our platform or violation of these Terms
- Your event listing, vendor profile, or other content submitted to our platform
- Your interactions or agreements with other users
- Any violation of third-party rights, including privacy and intellectual property
11. Content Moderation and Enforcement
11.1 Our Rights
KiesSlim reserves the right to:
- Monitor and moderate event listings and vendor profiles
- Remove content that violates these Terms or applicable law
- Suspend or terminate accounts for violations
- Cooperate with law enforcement when required
- Modify or discontinue services at any time
11.2 Reporting Violations
Users can report content or behaviour that violates these Terms via our contact form. We will investigate reports and take appropriate action, which may include content removal, account warnings, or permanent bans.
12. Account Termination
12.1 Termination by You
You may close your account at any time by contacting us via our contact form. Your event listings or vendor profile will be removed in line with our Privacy Policy's data retention terms.
12.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms
- You engage in fraudulent or illegal activities, including posting fake events or fake vendor profiles
- Your account remains inactive for an extended period
- Required by law or regulatory authorities
12.3 Effect of Termination
Upon termination, your right to access our platform ceases immediately.
13. South African Legal Compliance
These Terms are governed by South African law and comply with:
- Protection of Personal Information Act (POPI Act): Data protection and privacy
- Consumer Protection Act: Fair business practices, to the extent applicable to this platform
- Electronic Communications and Transactions Act: Electronic transactions and communications
- Cybercrimes Act: Online safety and security
13.1 Consumer Rights
Nothing in these Terms limits any rights you may have under South African consumer protection legislation. If any provision conflicts with your statutory rights, those rights will prevail.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. The parties submit to the exclusive jurisdiction of the South African courts.
14.2 Jurisdiction
Any legal proceedings arising from or in connection with these Terms or your use of KiesSlim shall be instituted in a competent South African court, including the Magistrates' Court or the High Court of South Africa, depending on the monetary value and nature of the claim. You consent and submit to the jurisdiction of such courts for these purposes.
14.3 Disputes Between Users — KiesSlim Not a Party
THIS CLAUSE IS OF CRITICAL IMPORTANCE. PLEASE READ IT CAREFULLY.
KiesSlim is not a party to any dispute between a vendor and an organiser, or between any other users. You explicitly agree that:
- • KiesSlim will not become involved in, mediate, or resolve any such dispute under any circumstances.
- • Any dispute arising from a stall booking, cancellation, non-payment, misrepresented event, or any other matter involving another user must be resolved by the parties themselves.
- • Where the parties cannot resolve the dispute amicably, the dispute must be referred to the South African legal system, including, as appropriate, the relevant Magistrates' Court or the High Court of South Africa.
- • You waive any claim against KiesSlim arising out of or in connection with any such dispute.
14.4 Disputes with KiesSlim
If you have a dispute directly with KiesSlim regarding these Terms or the operation of the platform, we encourage you to first contact us using our contact form so that we may attempt to resolve the matter informally. If the dispute cannot be resolved informally within 30 days of written notice, either party may pursue the matter through the South African courts as set out in clause 14.2 above.
15. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will:
- Notify users of significant changes via email or platform notifications
- Update the "Last updated" date at the top of this document
- Provide at least 30 days' notice for material changes
- Consider continued use of our platform as acceptance of updated Terms
16. Severability and Entire Agreement
16.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
16.2 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KiesSlim regarding your use of our platform.
17. Pricing
KiesSlim is currently free to use for both vendors and organisers. We reserve the right to introduce fees for some or all features in the future. If we do, we will give existing users at least 30 days' notice before any charge applies to their account, and continued free features will remain clearly distinguished from any paid features.
